Emergency services and limitation of liability

1. Sa is not an emergency service. Sa is a personal safety assistant. Sa is not emergency services, a 911 or emergency dispatch service, a security company, a medical provider, or a substitute for any of them. Sa does not contact police, fire, or medical responders on your behalf. If you are in danger or need emergency help, call 911 or your local emergency number immediately.
2. No guarantee of alerts, delivery, or response. Sa relies on your device, your battery, your network connection, location services, and third-party providers. Alerts, live video, audio, and location updates may be delayed, inaccurate, incomplete, or fail to arrive. Your emergency contacts may not see, receive, or act on an alert. Siri and other voice commands may not recognize your request. Sa cannot ensure that anyone will respond, or that a response will arrive in time.
3. AI-generated guidance. Sa uses artificial intelligence to converse with you, transcribe speech, and offer safety suggestions. AI output can be wrong, incomplete, or unsuitable for your situation. Sa's suggestions are general information, not professional safety, medical, or legal advice. You are responsible for your own decisions and actions, and for judging whether a suggestion is safe to follow.
4. Nearby services information. Information about nearby hospitals, fire stations, and other places comes from third-party data sources and may be out of date, incomplete, or incorrect. Distances and travel times are estimates.
5. Your responsibilities. You are responsible for keeping your contact details and emergency contacts current, for keeping your device charged and connected, for granting the permissions Sa needs, and for informing your emergency contacts about how Sa works. You are responsible for complying with recording and consent laws that apply where you use Guardian Mode, including laws about recording audio or video of other people. Use Sa only in ways that are lawful.
6. Disclaimer of warranties. SA IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SIREN Global, Inc. ("WE") DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SA WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT IT WILL PREVENT HARM, INJURY, OR LOSS.
7. Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, SA. THIS INCLUDES HARM ARISING FROM A DELAYED, MISSING, OR INACCURATE ALERT, LOCATION, RECORDING, TRANSCRIPT, OR AI RESPONSE, FROM THE ACTIONS OR INACTION OF YOUR EMERGENCY CONTACTS OR OF EMERGENCY SERVICES, OR FROM THE FAILURE OF YOUR DEVICE, NETWORK, OR ANY THIRD-PARTY SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO SA WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SA IN THE 12 MONTHS BEFORE THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS ($100).
8. What these limits do not cover. Nothing in these Terms limits liability that cannot be limited under applicable law. This can include liability for fraud, gross negligence, or willful misconduct, and in some places liability for personal injury or death caused by negligence. Some jurisdictions do not allow certain disclaimers or limits, so parts of this section may not apply to you, and you may have additional rights.
9. Assumption of risk. You understand that personal safety situations involve inherent risk, and that Sa is a tool to help you stay aware and keep trusted people informed. It does not remove risk. You choose to use Sa at your own risk.
10. Indemnity. To the extent permitted by law, you agree to defend and hold us harmless from claims arising from your unlawful use of Sa, including unlawful recording of others, or your violation of these Terms.
11. Third-party services. Sa uses third-party providers for storage, live audio and video, AI responses, voice, and maps. We are not responsible for those providers' services, outages, or actions, and your use of them is also subject to their terms where they apply.
12. Changes, severability, and governing law. We may update these Terms, and we will post the new version with an updated date. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms are governed by the laws of Delaware, without regard to conflict-of-law rules, and disputes will be handled in the courts located in Delaware, unless the law where you live requires otherwise.
